Introduction
Fit n Well Studio Inc. (FitnWell) is a premiere luxury wellness destination for women of all ages (Clients) located in Vaughan.  The services provided include mat, heated mat or reformer Pilates classes, red light therapy and sauna sessions. The Studio’s Café provides coffee, matcha and other prepared foods to enjoy.  In addition, merchandise and specialty curated Mind and Body selections are available for purchase.

This document sets out the terms and conditions governing the use of the services provided by FitnWell to Clients.  Please read these terms and conditions carefully before accessing or using our services. By accessing or using any part of our services, you agree to be bound by these terms. If you do not agree to all the terms and conditions of this agreement, then you should not access the website, app or use any services.

Account Creation and Responsibility
In order to access and use the services provided by FitnWell, Clients are required to create an account online. The Client agrees to provide accurate, current, and complete information during the account creation process and to update such information to keep it accurate, current, and complete.  FitnWell reserves the right to suspend or terminate any account that is suspected to contain inaccurate, not current, or incomplete information.

Clients are responsible for maintaining the confidentiality of their account login information and for all activities that occur under their account. Clients agree to immediately notify FitnWell of any unauthorized use of their account or any other breach of security. The Client is solely responsible for the activity that occurs on their account and must keep their account password secure. FitnWell will not be liable for any loss or damage.

Member Services & Policies

Class Registration: It is recommended to pre-register for classes on FitnWell app or website to secure a spot. Walk-ins are welcome but not guaranteed. Class reservations become available seven days prior and the booking window closes 5 minutes before class.

Reservations: Reservations for classes are made on a first-come, first-served basis. Users are encouraged to book early to secure their spot. FitnWell reserves the right to cancel or reschedule classes at any time. Users must be physically present and checked in at the start of your scheduled class or your spot may be given to a waitlisted Client. Should a system error arise that results in the booking of a service with an ineligible membership or credit type, FitnWell reserves the right to cancel your reservation.
Refunds & Cancellations: Clients must cancel at least 12 hours in advance or you will be deducted that credit. A $20 fee for no shows or late cancellations will be applied. Cancellations can be made online or in our app.  All classes and credit packages are non-refundable and non-transferable.

Waitlist: Once a class has reached full capacity, you will automatically be placed on the waitlist. If a spot becomes available up to 2 hours prior to class start, you will be notified via email or app notification (please ensure notifications are enabled) and auto added on the class list and charged or class credit taken. If you do not receive a notification, no spots have opened.

Late Policy: To maintain respect for our team and fellow clients, there is a 5 minute grace period after the scheduled class start time. After this window, late entry will not be permitted. Missed reservations will result in the deduction of the class credit and $20 penalty. Please note that instructors do not have the authority to override this policy.

Class Package Expiration: Please note that class expirations take effect from the date of purchase in monthly increments as noted on package

Memberships:  Memberships are charged on a monthly basis on the anniversary of the signup date.  Memberships are charged monthly until minimum membership commitment period (varies by membership type) expires or until cancelled thereafter.  Cancellations must be actioned online at least 10 days prior to billing.

Membership Freeze: As a member, all aforementioned policies will remain applicable and will not be waived. All membership freezes must be submitted in writing at least 10 days prior to the next billing cycle. All requests for membership freeze will result in a $20 administrative fee. Membership freezes are limited to a maximum of one month within any 12-month period. Failure to cancel your membership before the commitment period ends will result in automatic renewal of the membership.

Discounts and Promotions: Special offers, discounts, promotions, or discount codes cannot be combined. Some credit packs and discount codes are exclusively offered to first-time customers. A first-time customer is someone who has never attended a class at FitnWell, including but not limited to introductory packages or other marketing and promotional deals.

The creation of multiple accounts to gain access to discounts or promotions is strictly prohibited.  FitnWell reserves the right to merge such accounts without prior warning. Duplicate accounts that have been used to gain access to promotions or offers that would not have been available to the account holder had they not been in possession of multiple accounts will be charged for the full value of services received without prior warning.
Mobile Carrier Charges:  Our Site and Services offer mobile functionalities, such as booking classes for mat pilates, reformer, sauna and red light therapy. When receiving and replying to messages via SMS, MMS, or other electronic means, please note that your mobile carrier’s standard messaging and data rates will apply. It is your responsibility to verify with your carrier regarding these charges and any restrictions on mobile services.

Refund Policy

Class Packages: All classes and credit packages are non-refundable and non-transferable. No exceptions.

Memberships: All monthly membership packages are non-refundable and must adhere to the minimum month commitment. No exceptions.

Retail and Merchandise:  No returns or exchanges on any merchandise or goods purchased.

Food:  To enjoy our Café, you must consider any of your dietary restrictions or allergies. It is your responsibility to inform our staff of any concerns.  All food sales are final. We do not accept returns or refunds on any food or beverage purchases.

Studio Rules & Regulations

Overall Rules:  Access to and use of the Facility and participation in any of our programs, exercises, or classes are subject to your compliance at all times with the rules posted on www.fitnwellstudio.ca  website. The Studio Rules & Regulations may change from time to time without notice and are for your benefit and protection and must be complied with at all times. You shall follow all safety guidelines, instructions, and modifications provided by any of our instructors in order to minimize risk and ensure a safe practice. We reserve the right to prohibit, suspend, or limit your access to and use of our Facility at any time, without refund for any amounts paid to us, if you a) fail to follow our Studio Rules & Regulations or breach the terms of this Consent, b) cause a nuisance or disturbance, c) commit any illegal or immoral acts, or d) if we feel that your actions may endanger yourself or others.

Heated Mat, Saunas and Red Light Therapy: Due to high temperatures, the mat pilates, sauna and red light therapy could be dangerous to your health. We recommend that you consult a physician before your use of the services. Those with medical conditions such as high blood pressure, heart disease, and respiratory problems, and those who are pregnant, should avoid exposure to high heat.  Certain treatments and medications could cause adverse reactions with the red light therapy.

Alcohol, Smoking, Vaping or Use of Drugs: All strictly prohibited in all studio spaces and during classes. The Service Provider reserves the right to refuse service to any user under the influence of alcohol or drugs.

Personal Belongings: You agree that FitnWell is in no way responsible for the safekeeping of your personal belongings while you are present in the facility. You assume all risk of loss for any of your personal belongings.

Filming and Recording: You acknowledge that you may be photographed, filmed, or otherwise recorded while at the Facility. By attending at the Facility, you grant your irrevocable consent to FitnWell and its successors, assigns, and licensees to include your name, likeness, photographic image, mannerisms, and voice in any promotional and other media without compensation or credit, and for such promotional and other media to be exploited for any purpose whatsoever in any and all media now know or hereafter devised throughout the universe in perpetuity. All photographs, film or video footage, or other audio or video recordings, and any works derived therefrom, shall be the sole property of FitnWell and you waive any and all rights of personality, publicity, privacy, or other rights therein.

Intellectual Rights:  Content on the FitnWell Site, including logos, text, images, videos, and associated materials (the "Content) can not be copied, used, or distributed without FitnWell express written consent.

Solicitation: We do not allow any business activity or solicitation at the Studio. In particular, solicitation of any business competitive with our business is strictly prohibited.

Limitation of Liability

We may, in our discretion, prohibit, suspend, or limit your access to the Facility, upon notice to you provided at any time and for any reason, including without limitation failure to comply with our Studio Rules & Regulations. In some cases, notice of prohibition, suspension, or limitation may be provided orally by our staff member. Revocation, suspension, or limitation of access will be without limitation to any other rights or remedies which we may have at law or in equity, and we reserve the right to, in our discretion, prohibit you from accessing the Facility or participating in any FitnWell program, activity, or class in the future. FitnWell’s programs, exercises, and classes involve physical activity and involve risk of falls, physical injury, and accidents. Client’s must sign a Release of Liability, Waiver of Claims and Assumption of Risks Form prior to participating in any classes or utilizing any services in the Studio. By signing this Consent and using the Facility, you are representing and warranting to us, among other items, that you are in good health and have no injury, impairment, disability, disease, ailment, or condition that prevents you from safely engaging in exercise or Red Light or Sauna Therapy services or that increases your risk of injury or adverse health consequences as a result of your using our Facility and/or participating in any of our programs, activities, or classes.

Privacy & Communication

You consent to the use of your personal information. You may refuse or withdraw your consent at any time; however, we may not then be able to provide you with our full range of services. See FitnWell Privacy Policy.

Changes to Terms and Conditions

We reserve the right to modify or replace these Terms of Service at our discretion by posting the updated terms on the Site. Your continued use of the Site after any changes indicates your acceptance of the new Terms of Service.
